EU and Germany


In Europe, the General Data Protection Regulation (GDPR) forms the central legal framework for the handling of personal data – including in law firms and legal departments. In Germany, the following also apply:

  • BDSG (Federal Data Protection Act) – supplements the GDPR with national requirements.
  • BRAO & BORA – regulate the duty of confidentiality for lawyers and organisational requirements.

  • NIS2 Directive – applies to law firms or legal service providers that are considered critical infrastructures and must implement higher cybersecurity requirements.

In order to reliably meet the requirements of the GDPR and the BDSG, sensitive client data should be destroyed at least at security level P-4.
